Description of Coaching: Coaching is a partnership (defined as an alliance, not a legal business partnership) between Elisha D'Agostino and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional, or business goals and to develop and carry out a strategy/plan for achieving those goals.

 

1) Coach-Client Relationship

A. Elisha D'Agostino agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics). It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behavior.

 

B. Client is solely responsible for creating and implementing his/her physical, mental, and emotional well-being, decisions, choices, actions, and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with Elisha D'Agostino. As such, the Client agrees that Elisha D'Agostino is not and will not be liable or responsible for any actions or inaction, or any direct or indirect result of any services provided by Elisha D'Agostino. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.

 

C. Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time.

 

D. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education, and recreation. The Client agrees that deciding how to handle these issues, incorporating coaching principles into those areas, and implementing choices is exclusively the Client’s responsibility.

 

E. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders as defined by the American Psychiatric Association and that coaching is not to be used as a substitute for counseling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If the Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and Elisha D'Agostino.

 

F. The Client understands that to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance, and create the time and energy to participate fully in the program.

 

 

2) Services

The parties agree to engage in coaching in one of three ways, in-person, internet, or through telephone meetings. The coach will be available to the Client by e-mail and voicemail in between scheduled meetings.

 

3) Program and Fees

 

Discover Your Best Self 8-week Coaching Package – The fee is $2549 (taxes included)

·        Coaching Portal Account Included – a.k.a. Coach Accountable

 

·        Up to 10 additional hours for setting up and monitoring action in the coaching portal as well as reviewing and commenting on client's journal entries and worksheet responses.

 

Coach Accountable Disclaimer

Although this is included in the coaching package Elisha D’Agostino does not take any responsibility for the Client’s choice to use this software. It is the Client’s sole responsibility to understand Coach Accountable Terms of Service, Privacy, etc.

If the Client is not agreeable to Coach Accountable terms, the Client may choose to decline the invite and proceed with the package without it.

If the Client chooses to decline the Coach Accountable invite it will be the Client’s responsibility to track their actions and hold themselves accountable.

 

 

You have 12 weeks, from the date of your first coaching session to complete this package, after which this agreement will be considered fulfilled.

 

You have 24 hours to cancel or reschedule your coaching session at no loss to you. It is your responsibility to ensure you show up for your scheduled sessions, as the missed session is a lost hour unless otherwise agreed upon.

The calls/meetings shall be 1 hour in length. If the client would like the meeting to go longer than scheduled and Elisha D’Agostino is available to do so the extra time will be subtracted from the remaining hours left in the client’s program. If there are no remaining hours, the client must first pay for the extra time requested.

 

Elisha D’Agostino cannot guarantee the Client’s preferred hours of availability, the Client understands and agrees to work their schedule around Elisha D’Agostino.

 

 

Continuing Coaching after the package is complete – discounted rates – see terms below

 

As a thank you for your commitment to this coaching package Elisha D’Agostino offers discounted rate options after the completion of this coaching package or after the 12-week package has expired. The Client has the option to continue their coaching partnership with Elisha D’Agostino at one of the below-discounted rates. See below for Rate Options:

 

Bonus Offer Upon Completion of this package

 

Pre-purchase 12 hours of coaching at $125/hr for a fee of $1500. The Client must purchase this option within 15 days of completing this package. The 12 hours included in this bonus expire 12 months after the purchase date. This bonus can only be purchased once. The terms of this agreement apply to this purchase, except for the following exclusions: coaching portal, accountability tracking, or worksheets.

If you would like to keep your coaching portal access an additional $300 will be added to the $1500 for a total of $1800.

 

4) Procedure

The time of the coaching meetings and/or location will be determined by the Coach and Client based on a mutually agreed upon time. The Coach will initiate all scheduled calls and will contact the Client via video call or telephone depending on what has been agreed on.

 

5) Confidentiality

This coaching relationship, as well as all information (documented or verbal) that the Client shares with Elisha D'Agostino as part of this relationship, is bound by the principles of confidentiality outlined in the ICF Code of Ethics. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. Elisha D'Agostino agrees not to disclose any information about the Client without the Client’s written consent. Elisha D'Agostino will not disclose the Client’s name as a reference without the Client’s consent. Elisha D’Agostino destroys all notes and emails after coaching sessions are complete either by deleting them from the computer or shredding any paper notes. Elisha D’Agostino will only keep the signed coaching agreement on file for 7 years.

 

Confidential Information does not include information that: (a) was in Elisha D’Agostino’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by Elisha D'Agostino from a third party, without breach of any obligation to the Client; (d) is independently developed by Elisha D'Agostino without the use of or reference to the Client’s confidential information; or (e) Elisha D'Agostino is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to Elisha D'Agostino and as a result of such disclosure Elisha D'Agostino reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with Elisha D'Agostino promptly.

 

6) Release of Information

Elisha D'Agostino engages in training and continuing education pursuing and/or maintaining ICF (International Coach Federation) Credentials. That process requires the names and contact information of all Clients for possible verification by ICF. By signing this agreement, you agree to have only your name, contact information, and start and end dates of coaching shared with ICF staff members and/or other parties involved in this process for the sole and necessary purpose of verifying the coaching relationship, no personal notes will be shared.

According to the ethics of our profession, topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.

7) Coaching Session Cancellation Policy

Client agrees that it is the Client's responsibility to notify the Coach 24 hours in advance of the scheduled calls/meetings. Elisha D'Agostino reserves the right to bill the Client for a missed meeting. Elisha D'Agostino will attempt in good faith to reschedule the missed meeting.

 

Elisha D’Agostino retains the right to also cancel within 24 hours of the scheduled session. Cancellation made by Elisha D’Agostino will be made up at another date and not be a loss to the client.

 

8) Record Retention Policy

The Client acknowledges that Elisha D'Agostino has disclosed his/her record retention policy concerning documents, information and data acquired or shared during the term of the Coach-Client relationship. Such records will be maintained by Elisha D'Agostino in a format of her choice (digital/electronic) for a period of not less than 7 years.

 

9) Termination

Either the Client or Elisha D'Agostino may terminate this Agreement at any time with 1 week’s written notice. If the client chooses to terminate no refund will be given. If Elisha D’Agostino chooses to terminate a pro-rated amount for coaching hours remaining will be provided within 10 business days.

 

Except as expressly provided in this Agreement, Elisha D'Agostino makes no guarantees, representations, or warranties of any kind or nature, express or implied concerning the coaching services negotiated, agreed upon, and rendered. In no event shall Elisha D'Agostino be liable to the Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Client may incur, Elisha D'Agostino's entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount paid by the Client to Elisha D'Agostino under this Agreement for all coaching services rendered through and including the termination date.

 

10) Entire Agreement

This document reflects the entire agreement between Elisha D'Agostino and the Client and reflects a complete understanding of the parties concerning the subject matter. This Agreement supersedes all prior written and oral representations. The Agreement may not be amended, altered, or supplemented except in writing signed by both Elisha D'Agostino and the Client.

 

11) Dispute Resolution

If a dispute arises out of this Agreement that cannot be resolved by mutual consent, the Client and Elisha D'Agostino agree to attempt to mediate in good faith for up to 30 days after the notice is given. If the dispute is not so resolved, and in the event of legal action, the prevailing party shall be entitled to recover attorney’s fees and court costs from the other party.

 

12) Severability

If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

 

13) Waiver

The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.

 

14) Applicable Law

This Agreement shall be governed and construed by the laws of British Columbia, Canada without giving effect to any conflicts of laws provisions.

 

15) Binding Effect

This Agreement shall be binding upon the parties hereto and their respective successors and permissible assigns.

 

By signing this Coaching Agreement, you agree to hold Elisha D’Agostino free of any liability to you, your family, your business, or your associates in relation to the coaching you have agreed to partake in.
